Managed Marketing Terms of Service Print

  • 0

These Managed Marketing Subscription Terms apply to clients purchasing recurring managed marketing services from Web Express. These terms explain how monthly content quantities, fulfillment, approvals, add-on content, and production standards are handled. The content quantity limits and managed marketing terms do not apply to content that the client has self-created and then queued up in the different sections of the Marketing App, or website page or blog content that the client has created and posted to the website through the Web Express website hosting & managed content service.

1. Subscription Cycle

Managed marketing subscriptions operate on a monthly cycle beginning on the 1st day of each month and ending on the last day of that same month.

Each subscription level and its included monthly content quantity resets on the 1st day of each month.

Unused content quantities do not roll over to future months.

2. Included Monthly Content

Each managed marketing subscription level includes Web Express creating up to the amount of content included in that subscription level.

The advertised content quantity is the maximum amount of content available during that monthly cycle. It does not guarantee that the full amount of content will be created or published if the client does not need, request, approve, or provide adequate direction for that amount of content during the month.

The maximum amount of included content may be used at the client’s discretion during the active monthly subscription cycle.

3. Additional One-Off Content for Active Managed Marketing Clients

Clients with an active managed marketing subscription may purchase additional one-off content during their monthly subscription cycle. Additional content will be billed according to the client’s current subscription level.

Additional one-off content may include a social media post, email campaign, or blog.

Additional content pricing for active managed marketing clients is as follows:

Subscription Level Additional Content Price
Starter Level $125 each
Essential Level $100 each
Power Level $75 each
Elite Level $50 each

These prices apply per additional social post, email, or blog.

4. Managed Content for Marketing App Subscription Clients

Clients who do not have an active managed marketing subscription, but who do have an active Marketing App subscription, may purchase managed content at the Starter Level rate.

The price for managed content for Marketing App subscription clients is $150 each.

This applies per social post, email, or blog.

5. Client Approval and Feedback

All content requires client approval before publishing, sending, or final scheduling, unless otherwise agreed in writing.

If the client is unable to provide timely approval, required materials, or adequate feedback, the content may remain in draft status. In that case, the monthly subscription cycle may be missed.

Web Express is not responsible for missed publishing, sending, or scheduling dates caused by delayed client approval, incomplete feedback, missing materials, or lack of timely communication from the client.

There are no refunds on monthly subscriptions due to delayed approvals, unused content quantities, or content remaining in draft status.

6. Draft Content and Monthly Cycle Usage

Content that remains in draft status from a previous month does not automatically apply to the previous month once it is approved or published later.

If content from a previous month is approved, published, sent, or scheduled during a new monthly cycle, that content will count toward the new month’s subscription quantity.

Content is not backdated to a prior monthly cycle.

7. Fulfillment Terms

Service fulfillment occurs when Web Express creates the subscribed content and either publishes, sends, or schedules it.

The subscription cycle runs from the 1st day of the month through the last day of the month.

Published content refers to content that is posted immediately for public viewing, or content that is published for a future, scheduled run.

For fulfillment purposes, content may be considered fulfilled when Web Express:

  1. Creates and publishes content for the current month;
  2. Creates and schedules content for the current month;
  3. Creates and schedules content for a future month.

For example, if a client is subscribed to a level that includes two emails per month, Web Express may fulfill that subscription by creating and sending two emails during the current month, or by creating two emails and scheduling them for a future month.

However, under a two-email-per-month subscription, Web Express is not required to create two emails for the current month and also create two additional emails to be scheduled for a future month. That would equal four emails and would require a subscription level that includes four emails per month, or the purchase of additional one-off content.

8. Previously Scheduled Content

Previously scheduled content does not count against the content quantity for the month in which it is published, sent, or posted, as long as the content was created and scheduled during a previous monthly marketing cycle.

For example, if a client has a subscription that includes two emails per month, and Web Express creates two emails in January that the client requests to have scheduled for February, those two previously scheduled emails do not count against the client’s February content quantity.

When February begins, the client may still request two new emails to be created during the February marketing cycle, either to be sent in February or scheduled for a future month.

9. Active Marketing App Subscription Requirement

In order for future-scheduled emails, social media posts, blog posts, or other scheduled marketing content to run, the client must have an active Marketing App subscription during the month in which the content is scheduled to be published, posted, or sent.

If the client’s Marketing App subscription is inactive, canceled, expired, or otherwise deactivated, the Marketing App is be deactivated along with any future content schedules.

10. Recurring Email Campaigns

Recurring email campaigns, including drip campaigns or similar automated campaigns, do not count against the current month’s managed marketing content allotment as long as those campaigns were created and published during a previous monthly marketing cycle.

However, total monthly email recipient volume is still calculated and must remain within the Marketing App’s included monthly email allotment.

The standard Marketing App with Pro Subscription email allotment is 10,000 email recipients per month. If the client’s total monthly email recipient volume exceeds 10,000 recipients, applicable bulk email add-ons must be added to the client’s Marketing App service subscription.

11. Standard Content Production

Managed marketing subscriptions include standard content production.

Standard content production includes quality text content that is industry-specific, topic-specific, or otherwise relevant to the client’s business, audience, and marketing goals.

Standard content may include, but is not limited to:

  • Social media post copy
  • Email campaign copy
  • Blog content
  • Basic content layout or formatting
  • Accompanying image selection when needed

Social media posts, email campaigns, and blogs often require an accompanying image or visual asset.

Images or videos may be supplied by the client. If visual content is supplied by Web Express, it will typically be a content-related stock image, generated image, or simple supporting visual.

Web Express-provided visuals may include little to no text or graphic overlay unless otherwise agreed.

12. High-Production Content

Managed marketing subscriptions do not include high-production creative services unless specifically stated in writing.

High-production content may include, but is not limited to:

  • Custom graphic design
  • Advanced image editing
  • Video editing
  • Motion graphics
  • Custom illustrations
  • Complex visual layouts
  • Heavily designed marketing assets
  • Advanced creative direction or production work

If a client requests high-production content, Web Express may provide a separate quote. Hourly rates or project-based pricing may apply for graphic design, video editing, advanced creative work, or other production services outside the standard managed marketing subscription.

13. No Refunds and No Rollovers

Monthly managed marketing subscription payments are non-refundable.

Unused content quantities do not roll over into future months.

Content not created, approved, published, sent, or scheduled during the applicable monthly cycle due to client delay, lack of need, missing materials, or lack of approval is not eligible for a refund or rollover.

14. Client Responsibility

The client is responsible for providing timely feedback, approvals, brand guidance, access, information, images, videos, offers, topics, or other materials needed for Web Express to complete the managed marketing services.

Delays in providing these items may affect Web Express’s ability to complete, publish, send, or schedule content within the monthly subscription cycle.
